The present petition seeks to challenge an order rejecting a discharge application filed on behalf of accused by the present petitioners. Vide order dated th March, 2017 it is case of the petitioner that while rejecting the application for discharge the order is bereft of any reasons. Today when the matter is called, Mr. Gupte, learned Senior Counsel appearing on behalf of the petitioner states that he will approach the Sessions Court in revision. Mr. Gupte further states that revision application before the Sessions Court will be filed within one week from today.

In the circumstances, I pass the following order : (i) Petition is disposed of with liberty to the petitioner to approach the Sessions Court by way of revision.

(ii) In the event of any delay in approaching the Court, the Court will consider any application for condonation of delay in light of the pendency of this petition till date.

(iii) Parties to act on an authenticated copy of this order. (A. K. MENON, J.)
