Heard the learned counsel for the applicants and the learned counsel for the Intervener.

The applicants are apprehending arrest in C. R. No. I-169 dated 13.04.2017 registered with Narpoli Police Station, Bhivandi, District Thane under Sections 379, 420, 465, 467, 471 read with 34 of the Indian Penal Code and under Sections 103, 104, 107 of the Trade Marks Act. 3.
The applicants have already preferred an application for prearrest bail under Sections 438 of the Code of Criminal Procedure before the learned Additional Sessions Judge, Thane bearing No. 991 of 2017. The learned Additional Sessions Judge by its order dated 17.04.2017 was pleased to issue notice to the prosecution and the matter is now kept for hearing on 24.04.2017.

In my considered view, the order dated 17.04.2017 does not warrant any interference. However, the learned Additional Sessions Judge, Thane is hereby requested to hear the ABA No. 991/2017 and decide the same on 24.04.2017.
