1] On expressing my disinclination to entertain the application in the wake of material compiled in the charge-sheet, the learned counsel for Applicant seeks permission to withdraw the application. Permission is granted.

2] She, however, submits that the Applicant is arrested on 28.11.2020 and considering the nature of accusation even on conviction at the most he would face imprisonment for a maximum term of 7 years. His long incarceration without charge being framed is her worry.

(18)BA-1850-2021.doc 3] I find substance in the submission of learned counsel for the Applicant. As the Applicant would be kept incarcerated for an indefinite period and in an offence registered in the year 2020, the charge is not framed.

4] In the wake of above, the Special Court shall take necessary steps to frame charge within a period of six months from today. On failure to do so, the Applicant shall be at liberty to renew the request for granting bail.

5] Bail Application is disposed off as withdrawn with the liberty as above.
