Mr. Cama learned Counsel for the Respondent on instructions states that there is no objection if Miscellaneous Civil Application No. 108 of 2013 is allowed in terms of prayer clause (a) subject to the right to challenge the jurisdiction of the learned Principal District Judge, Family Court No. 1, Pune. 2.

As the issue of jurisdiction has been already raised by the Sharayu.

906-MCA-108-13.doc Respondent before the learned District Judge and the same is agreed to be decided along with other issues by the learned Principal District Judge, subject to the issue of jurisdiction, this Application can be disposed of. Learned Counsel for the Applicant has no objection, if issue of jurisdiction is kept open.

The Miscellaneous Civil Application is made absolute in aforesaid terms. Issue of jurisdiction is kept open. 4.

No order as to costs.

Learned Civil Judge, Senior Division, District Thane is directed to transmit all the papers and proceedings of Matrimonial Petition No. 24 of 2012 to the Family Court expeditiously. 6.

Both the parties are directed to appear before the learned Family Court, Pune on 15th December 2016. 7.
