The Learned Counsel for the Petitioner Mr. Sawant and the Learned Senior Counsel Mr. Talsania appearing for the Respondent No.1 tender consent terms bearing today's date evidencing the settlement arrived at between the parties. The consent terms have been signed by the consent workman Mr. Santosh Patil and Mr. Sawant as the Advocate for the Petitioner. The consent terms have also been signed by Mr. Datta Karnad Executive Director of the Respondent No.1 and Ms Radha Ved on behalf of M/s. Sanjay Udeshi & Co. who are the Advocates for the Respondent No.1. The Learned Counsel Mr. Sawant on instructions of the office bearer of the Union states that the said consent terms are acceptable to the Union. The concerned workman Mr. Santosh Patil is personally present in court and when put in the box and queried states that he has read and mmj
wp-2458-16-(901) understood the consent terms and the same are acceptable to him and he has signed them of his own free will and volition. The Executive Director Mr. Datta Karnad of the Respondent No.1 is also personally present in court and when put in box and queried states that the said consent terms are acceptable to the Respondent No.1 and that he has signed them of his own free will and volition pursuant to the authorisation given to him by the Respondent No.1. The undertakings given by the concerned workman Mr. Santosh Patil in clause (3) of the consent terms are accepted. The concerned workman Mr. Santosh Patil may apply for spread over under Section 89 of the Income Tax Act and the concerned authority may consider such application in accordance with law.
The consent terms are taken on record and marked as "X" for identification.
