By this application, the applicant - State seeks leave to file appeal against the part of the judgment by which the Sessions Judge, Greater Mumbai, by judgment dated 27/11/2014 in Sessions Case No. 749 of 2013 acquitted the respondent for offence punishable under Section 302 of the IPC.

We have heard learned APP and we have perused the findings recorded by the trial court. In our opinion, this is a fit case for granting leave.

We accordingly allow this application and grant leave as prayed for. Appeal filed by the State stands admitted. 4.

Action under Section 390 of Cr. P.C. be taken by the trial court by issuing bailable warrant for Rs.20,000/- against the respondent. 5.

This appeal to be heard along with Criminal Appeal No. 976 of 2014.
