The Petitioner has challenged the order dated 23/11/2022 passed by the Civil Judge, Junior Division, GhodnadiShirur, below Exhibit-81 in S.C.C.No.228 of 2018. By the impugned order, the application preferred by the accused for setting aside 'no cross' order was allowed and the accused was permitted to cross-examine the complainant; subject to payment of cost of Rs.7000/-. The petitioner is the original complainant in that case.

23-wp-2469-23 request is that, the directions be issued to the learned Trial Judge to conclude the trial within a reasonable time-frame because the trial is pending since the year 2018.

Since the petitioner is not pressing this petition, it can be disposed of. However, a request for making the trial time bound is also reasonable. Directing expeditious disposal of the matter cannot cause prejudice to any parties.

i)The Petition is disposed of as not pressed. ii)The Civil Judge, Junior Division, Ghodnadi-Shirur is directed to conclude the proceedings in S.C.C. No.228 of 2018 pending before him within a period of three months from today.
