The consent terms are tendered across the bar. The same are taken on record and marked "X" for identification. The consent terms are duly signed by learned counsel for the respondents who states that the respondent Nos.1 to 3 have signed the consent terms and rest of the respondents will appear before the Registrar (Judicial-I) and sign the consent terms within a

skn 2/2 387.06-fa--.sxw period of one month from today. The consent terms are also signed by Shri D.R.Navale, SDO, Panvel and the learned Addl.GP for the appellant- State. 2.

Hence, we pass the following order:

(i) The appeal and the cross-objection are disposed of in terms of the consent terms;

(ii) A decree/ award shall be drawn in terms of the consent terms only after the rest of the respondents sign the consent terms before the Registrar (Judicial-I) within a period of one month from today and only after the deficit court fee is deposited on the crossobjection; (iii) After the decree/award is drawn, the appellant will be entitled to refund of court fee on the appeal as per rules and the respondents will be entitled to refund of court fee on the cross-objection as per rules.
