The petitioner's tribe claim is still pending before the Scrutiny Committee. In the meanwhile, the petitioner apprehends that the educational institution will not allow the petitioner to pursue her studies for want of production of caste validity certificate. The petitioner is admitted against a seat reserved for Scheduled Tribe. He is claiming to be Thakur, Scheduled Tribe. The caste certificate forwarded by the petitioner at the time of her admission to first year D. Pharmacy course in the fourth respondent institution is now pending for verification and scrutiny of the Scrutiny Committee. In the meanwhile, the petitioner is now in the second year of this course.

On such a petition, which was directed to be produced urgently, it is stated, on instructions, by the learned AGP that the Scrutiny Committee will pass the requisite orders in accordance with law within a period of two months from today. We accept this statement, made on instructions, as an undertaking given to this court.

The petitioner's admission shall not be disturbed till the Scrutiny Committee passes appropriate order in accordance with law and should that be adverse to the petitioner, for a period of two months from the date of its communication.
