By this petition under Article 227 of Constitution of India, the Petitioner is challenging the order dated 30.01.2016 passed by 2nd Joint Civil Judge, Senior Division, Kalyan below Exh. 5 in Special Civil Suit No. 337 of 2014.

The learned Counsel for the Petitioner submits that the Respondent Plaintiff valued the Special Civil Suit No. 337 of 2014 for Rs.55,51,000/- Hence, the Appeal is required to be filed before the District Court. Therefore, he seeks permission to withdraw the present Writ Petition with liberty to file Sneha Chavan 1/2
