Heard the learned counsel for the applicant.

This is an application for modification of condition No. (iii) imposed upon the applicant by this Court while releasing him on bail by an order dated 30/04/2015 in Bail Application No.724/15.
The said condition reads as under :
"The applicant shall not enter the jurisdiction of the Chembur Police Station, till the conclusion of the trial." Nesarikar

It is the allegation against the applicant that he alongwith co-accused, obstructed the complainant and police from performing their lawful duties and therefore section 353 of the Indian Penal Code has been applied to the present case. At the time of hearing of the Bail Application No.724/15 applicant himself submitted that he was ready to abide any condition which may be imposed by the Court if the applicant is enlarged on bail. The learned Single Judge of this Court after hearing the applicant and after taking into consideration the said submission, has imposed the aforesaid condition. I am therefore of the considered view that no case of relaxation of condition is made out.

The application is accordingly dismissed.
