Petitioner is having substantive alternate remedy by way of preferring an application for discharge and without availing such remedy, Petitioner has directly filed present Petition under Article 226 of the Constitution of India.

In view thereof, learned Advocate for Petitioner on instructions seeks leave to withdraw present Petition with liberty to avail alternate remedy i.e. filing of an application for discharge as contemplated under the provisions of Criminal Procedure Code, before the trial Court. Leave and liberty granted.
