By this petition, the petitioners have impugned the order dated 5th March, 2016 below Exhibit-I passed by the learned Chief Judicial Magistrate in T. A. No. 3 of 2015.

Learned Counsel for the petitioners states that the delay is not caused on account of the petitioners but on account of the complainant. He submits that because of the said order, prejudice is caused to the petitioner. 3.

Perused the order dated 5th March, 2016 passed by the learned Judicial Magistrate First Class below Exhibit-I in T.A. No. 3 of 2015. SQ Pathan 1/2

wp.1566.16.22.doc There is nothing in the order which, in any way, prejudices the petitioner. The order has been passed directing the Presiding Officer to hear the case on day-to-day basis. No prejudice is caused to the petitioner by the said order nor is there anything in the order which suggests that the petitioner is responsible for the said delay. Hence, no interference is warranted in the impugned order. Petition is rejected.
