The applicant, who is accused in Crime No. 49 of 2023 registered at Bibwewadi police station, Pune for the ofences punishable under Sections 376, 377, 406, 420 and 506 (2) read with 34 of the Indian Penal Code, has fled the application for anticipatory bail before the Sessions Court.

It appears that on 27 February 2023, the Sessions Court had issued notice to the State and the application is still pending. 3.

The present application is fled as the Sessions Court has not granted any interim protection from arrest. As the application before the Sessions Court is still pending, I am not inclined to entertain the present application. However, considering the fact that there is no interim protection from arrest, the Sessions Court Dinesh S. Sherla 1/2

910-aba-1083-23.doc shall endeavour to decide the application for anticipatory bail fled by the applicant as early as possible and in any case within a period of 15 days from the date of receipt of copy of this order. 3.

The Application is disposed of.

Needless to mention that the Sessions Court shall decide the application on its own merits.
