Co-accused Sonu was already ordered to be released in ABA 681/2018 vide order dated 04/02/2019 in Crime no. 06/2018 registered with Kamothe Police Station for offence punishable under Sections 420, 406 r/w 34 of the Indian Penal Code.
2 2.703.18 aba.doc Pursuant to last order, both applicants have shown their bonafides by depositing amount of Rs. 5 Lakhs by each of them in this Court.
There are no antecedents.
The main accused Rajendra is already arrested. That being so, in my opinion, the Ad-interim protection needs to be confirmed. (A) In the event of arrest of the applicants in Crime no. 6/2018 registered with Kamothe Police Station, applicants be released on bail on executing P.R. bond in the sum of Rs. 25,000/- each with one or more sureties in the like amount. (B) Applicants shall attend Investigating Officer on 05/03/2019, 06/03/2019, 07/03/2019 & 08/03/2019 between 10.00 a.m. to 12.00 noon and furnish details as regards contact number, permanent address etc within two weeks from today.
(C) Investigating Officer shall collect the amount which is lying in this Court deposited by the applicants and may deal
3 2.703.18 aba.doc with same in accordance of provisions of Code of Criminal Procedure, 1973.
(D) Investigating Officer shall intimate the complainant about the recovery of total amount of Rs. 30 Lakhs in the crime in question.
Applications stand disposed of.
