At the outset, Mr. Sabrad, learned Counsel for the Petitioner makes a grievance that without being acquired Petitioner's land in question, the Respondent - Authority has allotted the same to third party (Respondent No. 5). By the order dated 3rd October 2017, the government was directed to file affidavit-in-reply. Till date, reply is not filed. Moreover, today the learned AGP seeks further time to file reply. This is very sorry state of affairs on the part of the State Government.

As and by way of last chance to the Respondent - State, we grant four weeks time to file affidavit-in-reply. Adjourned to 22nd February 2017.

Registry is directed to issue notice to Respondent No. 5, patilsr 1 / 2

returnable on 22nd February 2018. In addition to Court notice, advocate for the Petitioner shall serve the Respondent No. 5 by private notice either by hand delivery or through RPAD/Speed Post/Courier and file an affidavit of service before the returnable date, failing which petition shall stand dismissed without further reference to the Court.
