This is an Application under section 439 of Cr.P.C. filed by the aforesaid Applicant who is arrested in C.R.No.07/2020 registered with D.N. Nagar Police Station, Mumbai for offence punishable under section 306 of the Indian Penal Code.

A perusal of the Application reveals that the Application before the Sessions Court was already pending and that the Applicant has filed Application before this Court since no orders were passed by the learned Sessions Judge. Learned counsel for the Applicant states that he was compelled to file an application before this Court since the health of the Applicant was deteriorating. Since the learned Sessions Court has granted bail, learned counsel for the Applicant seeks leave to 1/2
