Heard learned counsel for both the sides.

This is an application for pre-arrest bail by the applicant involved in Crime No.I-84/16 registered by Kasarwadavli Police Station, Thane.

Perused the FIR according to which only involvement of applicant is that he was possessing some pistol like weapon on the day of incident on 4th April 2016 at 1.30 p.m along with coaccused, who are more than 12 in numbers. FIR is lodged one day after the incident on 5th April 2016.

My attention is invited by learned counsel for the applicant to the N.C. complaint lodged by one Sannar Shaikh prior

Tilak 2/2 (5)ABA-713-16 to present complaint, out of which present application arose, who claims to be the owner of the property of which admittedly, some Civil proceedings are pending having no reference in said complaint of any weapon possessed by applicant, much less than any weapon like pistol, as alleged in the report. Considering the facts as aforesaid, and applicant since was earlier protected by this Court, and had attended Investigating Officer and has co-operated with the investigation, though chargesheet is yet to be filed, considering applicant's involvement as aforesaid, interim protection granted on 22nd April 2016, is liable to be confirmed on the same terms and conditions, except directing applicant to further attend the Investigating Officer as and when required till filing of charge-sheet. Application is accordingly disposed off as allowed. (P.N. DESHMUKH, J)
