The respondent No.1 herein has filed eviction proceedings against the petitioner before the respondent No.2 - Estate Officer. 2.

By the order impugned, the respondent No.2 rejected the application filed by the petitioner to frame the issue in relation to maintainability of the eviction proceedings and jurisdiction as preliminary issue.

I am not inclined to entertain the present petition against the interlocutory order as the appeal is provided against the final order of the respondent No.2 and petitioner can raise all these issues in appeal, if such eventuality arises.

The Petition is dismissed.
