Heard learned counsel for the parties. The impugned judgment and decree is a money decree. By order passed today, the Appeal is admitted. Subject to the deposit of the decretal amount within period of ten weeks from today, deducting any amount if already deposited, there shall be interim relief in terms of prayer clause (a) of the Civil Application, during the pendency of the Appeal. Liberty is granted to the Respondent to withdraw the decretal amount so deposited subject to furnishing necessary security to the satisfaction of the Registry. If the amount is not deposited as stipulated, it will be open to the Respondent to execute the decree. (N.M.Jamdar, J.)
