Heard the learned counsel appearing for the petitioner and the learned counsel for the respondents. After completing the departmental enquiry, the respondents issued show cause notice of termination and/or taken action based upon the same. Time was granted to the petitioner to file reply. The petitioner has already filed reply. The decision is yet to be taken by the department. The statement is also made that the remedy of filing statutory appeal/departmental appeal is available to the petitioner. Therefore, the factual aspects, if any, can be gone into again by the appellate authority. The petitioner is also permitted to file additional material in support of his case in view of the acquittal order so recorded above. The respondents to consider the same in accordance with law. The petition is disposed of with liberty. All points are kept open. No costs.
