This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicants for pre-arrest bail in C.R.No.403/2021 registered with Central Police Station, Ulhasnagar, Dist. Thane for offences punishable under sections 406, 409, 420 r/w. 34 of the Indian Penal Code.

Heard Mr. Aabad Ponda, learned senior counsel for the Applicants and Ms. A.A. Takalkar, learned APP for the State. I have perused the 1/3
records and considered the submissions advanced by the learned counsel for the respective parties.

Bail Application No.745/2022 filed by the other co-accused - Manmohan Dilipsingh Ailsinghani was disposed of in view of the consent terms filed by all the victims. The victims have consented for grant of conditional bail to all the co-accused in C.R.No.403/2021 in view of which the present Applicants who are also the co-accused in C.R.No.403/2021, are granted pre-arrest bail. Hence, the Application is allowed on following terms and conditions :- (a) In the event of arrest of the Applicants in C.R.No.403/2021 registered with Central Police Station, Ulhasnagar, Dist. Thane, they shall be released on bail on furnishing bail bonds in the sum of Rs.50,000/- each with one or two sureties in the like amount ;
(b) In the event, the Applicants does not fulfill any of the conditions as specified in the order dated 20/04/2022 in BA/745/2022, the pre-arrest bail shall stand cancelled without further reference to this Court ;

(c) The Applicants shall report to the Investigating Officer as and when required by them ;
(d) The Applicants shall keep the Investigating Officer informed of their current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.

The Application stands disposed of.
