The main relief applied for in this petition is to quash and set aside the order of learned Civil Judge Senior Division, Panvel on application under Order 39 Rule 1 and 2, at Exhibit 5 of Civil Suit No. 420 of 2009 dated 3rd December, 2010.

As against the order of such nature, an appeal is maintainable. Accordingly, there is no reason to entertain the present petition.

This petition is dismissed with liberty to the petitioner to avail alternate remedy.
