The Petitioner challenges the no confidence motion passed by the Gram Panchayat against the Petitioner and the order passed by the Addl. District Collector thereby rejecting the appeal of the Petitioner. 2.

Perusal of the material placed on record would reveal that out of 7 members, 5 members have voted in favour of no confidence motion. The requirement under the statute is for 2/3rd of the strength of the Gram Panchayat for passing such a resolution. Admittedly, the said requirement is fulfilled. No case is made out for invoking jurisdiction under Article 226 of the Constitution. Petition is therefore rejected. (M.S. KARNIK, J.) (B. R. GAVAI, J.)
