The proposal seeking approval to the appointment of the Petitioner as the Laboratory Assistant is rejected.

The contention of the Petitioner is that the Petitioner was appointed on the post of Laboratory Assistant on 11th July 2012. From perusal of the order, it transpires that all Government Resolutions referred to in the order are subsequent to the appointment of the Petitioner. 3.

The policy existing on the date of the Petitioner will have to be taken into consideration. In the light of that the impugned order is quashed and set aside.

The Education Officer shall reconsider the proposal seeking approval to the appointment of the Petitioner as Laboratory Assistant afresh. He shall consider the position existing on the date of appointment of the Petitioner expeditiously and preferably within six weeks. 5.

The Writ Petition is disposed of. No costs.
