Mr. Avinash Thorat, learned counsel for the applicant has submitted that the applicant has filed another application being Criminal Application No. 634 of 2017 for releasing him on bail. The said application has been disposed of by order dated 04th July, 2017 whereby, this Court (Coram : Sandeep K. Shinde, J.) had already suspended the substantive sentence and enlarged the applicant on bail pending hearing of the appeal. In view of the said order, the present application is rendered infructuous. He, therefore, seeks leave to withdraw this application.

Hence, Criminal Application No. 635 of 2017 is dismissed as withdrawn.
