The applicant has taken out application for expeditious hearing of Writ Petition No.2785/2013.

In Criminal Writ Petition challenge is to the order dated 30/12/2011 passed by the Police Commissioner, Solapur and the appellate order dated 8/3/2013.

Arms license has been declined by the Police Commissioner because Civil Suit is pending and grant of license may have serious implication. The Appellate Authority has upheld this order. Reasons given by the Petitioner in justification of his demand of arms license are cash coming to him regularly and need to deposit it every day and for security and safety purpose in the area. These reasons

How pending civil suit can affect request for grant of arms license is not apparent from any order.

We therefore quash and set aside both orders and request made by the petitioner on 21/4/2011 is restored back to file of the Police Commissioner, Solapur. Said office shall apply mind to the needs explained by the petitioner and pass fresh orders within a period of three months from the date of communication of this order. 8.
The petition is thus partly allowed and disposed of. The Application is also disposed of.
