Heard learned Counsel for the respective parties. The learned Counsel for the respondent no.2 i.e. original complainant on earlier occasion in Criminal Writ Petition No.1739 of 2015 had stated that the petitioner i.e. original accused no.3 in the complaint filed before the learned Trial Court has wrongly been impleaded as an

wp.1736-2015 accused no.3. The learned Counsel for the respondent no.2 reiterates the said statement with regard to the present petitions and submits that the petitioner who had been impleaded as accused no.3 before the Trial Court in the present writ petitions has been wrongly arraigned as an accused and seeks leave of this Court to drop the proceedings against the petitioner from the said proceedings. Leave as prayed for is granted. The said statement is accepted as an undertaking to this Court. In view of the statement made by the learned Counsel for the respondent no.2-original complaint, the petitioner who has been added in the respective case numbers as mentioned in the present writ petitions are dropped from the said proceedings.

The Writ Petitions are disposed of in the aforesaid terms. (A.S. GADKARI,J.)
