For the reasons set out in the Civil Application the delay in the institution of the First Appeal is condoned. 2.

Since, this appeal relates to the year 1996, it is fixed for final disposal on 23 February 2017. The appellants to file private paper book / notes of evidence / documentary evidence if they so desire on or before the next date. Copy thereof to be furnished to the learned counsel now appearing for the respondent."

2] Today, neither any representative of the appellant nor their Advocates are present. Private paper book / notes of evidence have also not been filed.

3] The matter relates to the year 1996 and has been basically pending because no proper steps were taken by the appellant - State. No further indulgence can be granted.
