This Bail Application is moved by the applicant/accused, who is undertrial prisoner, is facing charges under sections 395, 363, 170 and 506 of the Indian Penal Code in C.R. No. 53 of 2014 in Sessions Case No. 115 of 2014 pending before Alibaug Sessions Court. 2.

This Court has rejected the Bail Application of the applicant/accused on 10th June, 2015 and has given liberty to move fresh Bail Application after 9 months. Hence, this Bail Application is moved by the applicant/accused from jail.

The learned counsel, who is appointed as amicus curiae for the applicant/accused, has submitted that the applicant/accused is poor. 1 / 2

902.BA967_2017.doc His wife and two minor children are dependent on him. He is only the breadwinner in the family. He is in Taloja prison since last three years. The learned counsel submitted that the applicant/accused be granted bail.

Considering the order passed earlier, the learned Sessions Judge is hereby directed to frame charge and proceed with the matter and expedite it preferably on or before 10th December, 2017. The learned Judge is requested to follow Section 309 of Cr. P.C. The prosecution to keep the witnesses present on all the dates. 5.
