Heard the learned Counsel appearing for the Applicant and the learned Counsel appearing for the Respondent. A substantive Family Court Appeal preferred by the Applicant was dismissed for non removal of office objections.

The Appellant cannot be allowed to suffer as the advocate for the Appellant could not remove the office objections.

With a view to give one opportunity to the Appellant to prosecute the Appeal, we allow the Application in terms of prayer clauses (a) and (b). Registry to accept the Paper Book filed by the Applicant.

Place the Appeal, as it is, on the final hearing cause list of the week commencing from 3 October 2016. We make it clear that under any circumstances, no adjournment will be granted to the Appellant.
