Heard the learned counsel for the parties. The learned counsel appearing for the Respondent No.2 - original complainant with utmost fairness at its command submits that the Petitioner who has been arrayed as accused No.3 in the complaint bearing C.C.No.1823/SS/2014 which is filed in the Court of Metropolitan Magistrate, 28th Court, has wrongly been impleaded as accused No.3. He submits that he has instructions from the original complainant to drop the name of original accused No.3 i.e. the Petitioner herein from the said original proceedings. In view of the statement made by the learned counsel for the Respondent No.2 - original complainant, the proceedings as against the Petitioner from case No.1823/SS/2014 are dropped. The Petition is allowed in the aforesaid terms. (A.S. Gadkari, J.)
