Perused the contents of the letter written by the convict Sunil Baban Pingale wherein it is stated that he may be removed from cell meant for the convicts to whom death sentence has been awarded and kept in normal cell i.e. the cell means for the convict to whom life imprisonment sentence has been awarded.

Since the petition is pending from 2013 no fruitful purpose would be served for keeping the petition pending. Hence we pass the following order :- The Superintendent of Jail Yerawada Central Prison, Pune is directed to make it appropriate decision on the grievance raised by the petitioner, if already not taken in accordance with law and keeping in view of relevant procedure, as Ethape

While considering the request of the petitioner, the concerned Authority shall kept in view the letter written by Joint Secretary (Judicial) addressed to the Additional Chief Secretary, and then take appropriate decision.

With the above directions writ petition stands disposed of. 5.
