. Heard learned Counsel for the Petitioner and learned AGP for the Respondent-State.

The subject matter of the controversy in the present petition concerns the complaint made by the Petitioner in respect of certain acts and dealings by office bearers of Respondent No.4-college, which, according to the Petitioner, are illegal and disclose misappropriation of funds. The Petitioner seeks directions for conducting an inquiry in pursuance of his complaint.

WP 1414-21.doc It is not in dispute that in pursuance of the Petitioner's complaint, an Enquiry Committee to make a preliminary investigation was appointed by Director, Medical Education and Research, Mumbai (Respondent No.3). That committee has prepared its report, which has already been presented to the Director. The report, however, has not yet been forwarded to the Respondent-State for action. Learned AGP, however, informs the court that the process of forwarding this report to the State is presently under way. Learned AGP submits that after the report is submitted to the Respondent-State, suitable action/further step shall be taken by the Government within a reasonable period.

On these facts, the petition can be conveniently disposed of by directing Respondent No.3-Director Education and Research to forward the report of the enquiry committee to Respondent No.2-Secretary, Medical Education & Drugs Department of the State of Maharashtra, within a period of two weeks from today. It is ordered accordingly. Within four months of receipt of that report to the Respondent-State shall process the same and take an appropriate decision in the matter.
