Learned APP has submitted that in the present case i.e. in Session Case No.357 of 2015 pending before the Session Court at Thane. The Court has recorded substantive evidence of one witness. Learned Counsel for the applicant vehemently submits that there is delay in proceeding with the trial as the First witness was partly examined in February, 2016, however, no progress in the trial. At this stage, it would not be possible to ascertain as to why the trial Court has not proceeded further. The learned Session Judge, Thane shall make an endeavour to conclude recording of evidence as far as possible, without giving unwarranted adjournment to the prosecution and shall also ensure that the accused is produced before Court on each and every date. Learned Counsel for the applicant also submits that the applicant is of 58 years old and is a heart patient, in case of emergency or if so required the applicant be given proper treatment at the hospital by the Jail authority.
