This is an application for anticipatory bail in C.R. No. 12 of 2021 registered with Ghatkopar Police Station, Mumbai for offence punishable under Sections 326, 323 & 504 of Indian Penal Code. The FIR is registered on 6th January, 2020. 2.

The sister of complainant is married to applicant. She has filed proceedings under Domestic Violence Act and Divorce before family Court. On 5th January, 2021, applicant abused mother and sister of complainant. The complainant intervened. He was assaulted with piece of tile on his nose. The applicant also assaulted father of complainant. His gold chain was missing. Sajakali Jamadar

The applicant was granted interim protection vide order dated 16th June, 2021.

Learned APP has pointed out the injury certificate of the injured which indicate that he had suffered CLW on the nose. 5.

Considering the factual aspect, Custodial interrogation of the applicant is not necessary. Interim protection granted by this Court can be confirmed.

Hence, I pass the following order:

ORDER

(i) Anticipatory Bail Application No.1143 of 2021 is allowed;

(ii) In the event of arrest of the applicant in connection with in C.R. No. 1143 of 2021 registered with Ghatkopar Police Station, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iii) The applicant shall appear before the investigating officer on 7th, 8th & 9th July, 2021 between 11.00 a.m. to 1.00 noon and thereafter as and when called for till filing of chargesheet. (iv) Anticipatory Bail Application stands disposed of accordingly.
