Heard Mr.Deepak Kushwaha, learned counsel for the petitioner, Mr. A.R. Metkari, learned AGP for the State and Mr.Rakesh Agrawal, learned counsel for the respondents, at length. 2.

W.P. No.8117/2016 takes exception to the order dated 15.2.2016 passed by the Competent Authority, Konkan Division, Mumbai in Case No.16/2012. By that order, the Competent Authority 1 / 2

905.WP.8117-16-&-987-17.doc directed Ravikumar Rajan Pandayan, the respondent therein, to pay to the respondents herein Rs.32,18,322/-. The respondents were at liberty to appropriate the amount of security deposit towards the said compensation / damages. The Competent Authority further held that the respondents herein are entitled to get the amount of Rs.8 Lakh along with interest thereon if any.

By W.P. No.987/2017 the petitioners have prayed for dismissal of the Execution Application dated 19.9.2014 (Exhibit-O, pages-74 to 85) instituted by the respondents herein for removal of Ravikumar Rajan Pandayan from bunglow No.87/A, Collectors Colony, R.C. Marg, Mahul Road, Chembur, Mumbai - 400 074 and to hand over possession to the respondents herein, amongst other prayers. 4.

After arguing the Petitions for quite some time, Mr.Kushwaha on telephonic instructions from the petitioner, seeks permission to withdraw these Petitions. Mr. Agrawal has no objection. 5.

In view thereof, on the motion made by Mr.Kushwaha, the Petitions are allowed to be withdrawn and are dismissed as withdrawn. Order accordingly.
