Mr.Niketan Nakhawa waives service for Respondent Nos.1 and 2.

By this Application, the Applicant prays for condonation of delay of 1 year and 49 days for filing the First Appeal. 4.

The learned counsel for the Applicant submit that the Applicant is Insurance Company after passing the order passed by MACT and after collecting the documents from the Trial Court delay is caused to file the Appeal.

The Tribunal has not considered the evidence produced by the Applicant before the Tribunal and the Applicant wants to put his side by way of Appeal. Hence, requested to allow the Application. 6.

The learned counsel for the Respondent Nos.1 and 2 submit that Court may pass appropriate order. 7.

Considering the submissions of both counsel, the Application is allowed. The delay of 1 years and 49 days caused to filing the Appeal is condoned.
