Mr.Sharma, the learned counsel holding for Mr.Vashi, the learned counsel for the appellant, states that the appellant has taken away the case papers and, therefore, the counsel does not have any instructions in the matter. On 5th January, 2015 none had appeared on behalf of the appellant. On the subsequent dates of hearing also similar statement was made by the learned counsel and an adjournment was sought. It appears that the appellant is not desirous of prosecuting the first appeal. Hence, the same is dismissed for want of prosecution.
