By this Civil Application, Applicant is seeking condonation of 48 days delay in filing First Appeal challenging the judgment and award dated 29.9.2017 passed by MACT, Solapur in MACP No.226 of 2011.

38 caf44-19.doc learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:

a) Delay in filing First Appeal is condoned.

b) Civil application stands disposed off accordingly.

c) No order as to costs.

d) Liberty granted to the Respondent original Claimant to prefer appropriate Application for withdrawal of the amount and that Applicant be decided on its own merits.
