Heard learned counsel for the applicant and learned APP.

This is an application for pre-arrest bail in connection with offence punishable under Sections 376, 406, 420 of the Indian Penal Code registered vide C.R.No.830 of 2020 with the MIDC Police Station.

It is alleged by the complainant that in the month of February 2019, the applicant contacted her through Facebook and developed friendly relations. It is then alleged
that thereafter they met on some occasions when they had physical relations. The allegation is that when the issue of marriage came, the applicant started avoiding her and ignoring her.

It prima facie appears that the relationship is a consensual relationship. There are no antecedents against the applicant.

Learned APP, on instructions, submitted that the applicant has co-operated with the investigation and the chargesheet has been filed. He submits on instructions that the Investigating Officer does not need custody of the applicant.

The applicant is working in Dubai. Though he is in Dubai, he has co-operated with the investigation and attended the Investigating Officer. Hence the application deserves to be allowed by passing the following order.
O R D E R
(a) Application is allowed.
(b) In the event of arrest in connection with C.R.No.830 of 2020 registered with the MIDC Police Station, the applicant-Chirag Satish Sharma shall be
released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or more sureties in the like amount.
(c) The applicant shall report to the concerned police station as and when called for.
(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police OfÏcer and shall not tamper with evidence.
(e) The applicant shall furnish the details of his residential address and phone numbers to the investigating officer.

The application is disposed of.
