Heard learned Counsel for the applicant and the learned A.P.P for the State.

Learned Counsel for the applicant submits that the learned Additional Sessions Judge, Mumbai, while granting bail to the applicant vide order dated 4th November, 2011, had imposed certain conditions, one of which is not to enter Thane District, which was modified by this Court vide orders dated 30th October, 2012 and 15th December, 2014 on certain terms and conditions.

Learned Counsel for the applicant submits that the present application has been filed for the temporary relaxation of the condition No. (i) of para 8 imposed by this Court (Coram : Abhay M. Thipsay, J.) vide order dated 15th December, 2015 in Criminal Application No. 347 of 2014. He states that a function is to be held at Abhinav Education Campus on 25th April, 2015 at 6:00 p.m. onwards, which is organised by the Abhinav Shetkari Shikshan Mandal, Goddev Village, Bhayandar. Learned Counsel for the applicant submits that it is necessary for the applicant to attend the said function, as he is the member of the said School and certain important decisions are to be taken in the said function/meeting. The invitation card is annexed at page 60 of the application.

Learned A.P.P has no objection if the said condition is relaxed only for a few hours on 25th April, 2015.

Considering the fact that the applicant is seeking relaxation of the aforesaid condition only for few hours on 25th April, 2015, this application is allowed. The applicant is permitted to attend the school 2/3

function/meeting to be held on 25th April, 2015 from 6:00 p.m. to 10:00 p.m. at Abhinav Education Campus, Goddev Village, Bhayandar. 6.

Rest of the conditions in the order dated 15th December, 2014 shall remain as it is.

Application disposed of accordingly.
