This application is moved for cancellation of pre-arrest bail, which was granted by the Additional Sessions Judge, Pune on 13th January 2016 in Criminal Bail Application Nos. 4428 of 2015 and 4429 of 2015.

The learned prosecutor submits that as per the orders passed in favour of the respondents-accused while granting pre-arrest bail in C.R. No. 612 of 2015 registered with Wakad Police Station for the offences punishable under sections 409 and 420 read with 34 of the Indian Penal Code, they were directed to attend the police station on every Sunday in between 11.00 a.m. to 2.00 p.m. However, they are

Trupti 2 / 2 07-APPLN-253-2016.doc not co-operate with the Investigating Officer, despite of two notices of production of the documents. In the notices, there was a query made by the Investigating Officer to the respodents-accused, but they did not give reply or explanation in respect of the objections of the notices raised at the time of auditing report.

The learned counsel for the respondents-accused submits that they have attended the police station on every Sunday for one year and also co-operate with the police.

Under such circumstances, I am of the view that there is no need to cancel the pre-arrest bail granted by the Additional Sessions Judge, Pune. The respondents-accused are to put on fresh condition as follows:

ORDER

The respondents-accused shall attend the concerned police station on every Saturday and Monday in between 11.00 a.m. and 2.00 p.m. i.e. from this Saturday till 10th April 2017.
