Applicant who has been released on bail vide order dated 14th August, 2018, seeks modification in terms

2/3 APPLN-587-2019 (SR.17) of the said order so as to bring it in consonance with order dated 24th January, 2019 in Criminal Application No. 1699 of 2018 and order dated 26th February, 2019 in Cri. Application No. 238 of 2019.

After hearing respective Counsel, we find that, later two applications were moved by co-convicts and they have been asked to report to the trial Court twice in each year, during the pendency of Appeal. The present applicant has been ordered to report to Dongri Police Station every month.

In this situation, we modify the terms and conditions of his release as under :

(i)the applicant shall furnish to the Superintendent of Jail/Superintendent of trial Court and also to Dongri Police Station and also place on record of this Appeal, Affidavit disclosing the address where he shall always be available during the pendency of this Appeal with contact numbers and other similar details.

3/3 APPLN-587-2019 (SR.17) (ii) Similar details in relation to sureties furnished by him shall also be kept on record. (iii) he shall report to trial Court on first Monday in the month of January and July of every calender year at 11.00 a.m. till the final disposal of this Appeal.

(iv) In case of default or failure to comply with these terms and conditions, the trial Court shall be entitled to take him in custody.

(v). Cri. Application No. 587 of 2019 is accordingly partly allowed and disposed of.
