CORAM: A.M.DHAVALE, J DATE : 10TH OCTOBER, 2018 P.C The respondent is served through bailiff and also by private mode but, he has not filed appearance. The respondent is serving at Mumbai and has filed Marriage Petition against the applicant-wife in the Family Court, Bandra. Due to matrimonial dispute, the applicant was constrained to reside with her parents at Gadhinglaj District Kolhapur. The applicant is not having any source of income. She has a daughter aged about 5 years. 2.
For the reasons afore-stated and relying on the judgement of SUMITI SINGH's case AIR 2002 SUPREME COURT 396 wherein it is observed that in such matters convenience of wife
RNG 2/2 4-mca.113.18 is to be looked at, in the light uncontroverted facts, the application is allowed under section 24 of the Code of Civil Procedure, 1908. 3.
Marriage Petition No.L-277 of 2018 is transferred from Family Court, Bandra Mumbai to the Civil Judge, Senior Division, Gadhinglaj District Kolhapur.

The Registrar, Family Court, Bandra, Mumbai to transmit the record of Marriage Petition No. L-277 of 2018 to the transferee Court of Civil Judge, Senior Division, Gadhinglaj District Kolhapur.

The parties shall remain present in the transferee Court on the next date fixed in the matter or in case no intimation is given, to remain present on 1.11.2018.
Misc.Civil Application is disposed of.
