The PIL petition does not suggest that the pond in question was a public pond, nor it was a natural pond or a pond constructed by some public authority. It is submitted that one Mr. Mhatre had constructed the pond and now the same is closed. There are huts constructed at the said place.

It is not the case that some public property is being misused. We do not find any public interest involved in the matter, nor the person who is allegedly carried out the constructions is party to the PIL petition.
