Learned counsel for the Petitioner submits that he is interested in getting the trial itself decided within a reasonable period. He submitted if the trial is made time bound, he is not pressing this Petition.

No party can have objection for expeditious disposal of the matter. Therefore, I am inclined to direct that the trial be concluded within a time bound manner. At the same time, it is also necessary to clarify that I am not interfering with the impugned order whereby the learned Magistrate had directed Digitally signed by MANUSHREE NESARIKAR Date:

Hence, the following order :

O R D E R

(i) The trial is expedited.

(ii) Learned Judicial Magistrate First Class, Pimpri, shall expeditiously conclude the hearing of the S.C.C.No.432 of 2020 and as far as possible shall conclude it within a period of four weeks from today.

(iii) It is made clear that I have not interfered with the impugned order dated 25/01/2023 passed by the learned Magistrate directing the Petitioner/accused to deposit 10% amount of the cheque within the prescribed period. The Petitioner will have to abide by the said order. (iv) With these observations, the Petition is disposed of, as not pressed.

(v) All contentions regarding merits of the matter of both the sides, are specifically left open.
