By this Application, the Applicant has sought to issue notice to the Respondent No. 5 by publication.

The Learned Counsel for the Applicant states that the Respondent No. 5, was the Opposite Party No. 1 in the Claim Petition Tauseef

50-CAF.201.2019.doc and that he was served at the same address as mentioned in the Application for Condonation of Delay. Notice issued to Respondent No. 5, at the same address has returned unserved with remark "insufficient address". She further states that the Applicant does not know his present whereabouts. In the light of the said statement and in view of the grounds stated in para 3 of the Application, the Application is allowed. Issue notice to the Respondent No. 5 in term of prayer clause (b).
