Learned APP submitted that the proper remedy, for the reliefs claimed herein, is to file an Appeal under Section 6C of the Essential Commodities Act. On instructions, learned APP states that the Authorities will not conduct auction of the confiscated property for a period of three weeks from today. He further submitted that in the meantime, the Petitioner can approach the appropriate Deshmane(PS)

In response to these submissions, learned counsel for the Petitioner states that he does not press this Petition at this stage. He seeks liberty to approach the appropriate Appellate Authority challenging the same impugned order of confiscation of the goods. He seeks permission to withdraw this Petition with such liberty. 3.

Hence, the following order:

i. The Petition is allowed to be withdrawn with liberty to the Petitioner to approach the appropriate Appellate Authority. If such an Appeal is preferred, it shall be decided in accordance with law.
