At the outset, Mr. Deokar, learned Counsel appearing for the Applicant states that the trial has already commenced and about 10 witnesses have been examined. However, he states that the Applicant is seriously ill and therefore, the Applicant be granted leave to file Bail Application seeking temporary bail on the ground of medical condition in the trial Court. He states that the learned Trial Court be directed to dispose of such temporary Bail Application on the ground of medical condition expeditiously.

Mr. Deokar, learned Counsel appearing for the Applicant states that in the above circumstances, he has instructions to withdraw the present Criminal Bail Application. 3.

Accordingly, the Bail Application is allowed to be withdrawn. 4.

However, liberty is granted to the Applicant to file a Bail Application seeking temporary bail on the ground of medical condition before the learned Trial Court. If such Bail Application is filed within a period of one week from today, the learned Trial Court is requested to dispose of the same expeditiously within a period of 15 days.

Accordingly, the Bail Application is disposed of, subject to above.
